2016 RIVER TO RIVER RAFFLE TO ROLL
The RIVER TO RIVER, CORP. and MARION TOYOTA's car ("Raffle") begins on Friday June 3, 2016 and ends on Saturday, October 1, 2016 or within 10 business days of the final raffle ticket being sold. ("Raffle Period"). RIVER TO RIVER CORP. has obtained a Marion, IL Raffle License to Conduct Games of Chance. The raffle drawing is October 1, 2016 or 10 business days after the final raffle ticket has been sold, at approximately 12:00 p.m. (CST) in Marion, IL 62959. The grand prize is a vehicle chosen by the grand prize winner from 5 possible vehicles. Delivery of the vehicle is at Marion Toyota, 3300 West DeYoung St. Marion, IL 62959. All proceeds shall benefit RIVER TO RIVER CORP.'s programs and services. A limit of 1,000 tickets shall be sold; a minimum of 700 tickets must be sold or RIVER TO RIVER CORP. and/or Marion Toyota reserve the right to cancel the raffle, refund the payments subject to the same process and time limits as claiming the prize. Tickets may be purchased in person at any RIVER TO RIVER CORP.'s office, Marion Toyota, Banterra Bank or a representative of one of these organizations. The prize winner will be posted on RIVER TO RIVER CORP.'s website on or about Monday, October 3, 2016. The Raffle is void where prohibited by law.
1. RAFFLE ELIGIBILITY.
All persons age 18 and over who have U.S. addresses are eligible to win the Grand Prize. Board members and employees of RIVER TO RIVER CORP., Marion Toyota Banterra and their immediate families are eligible to win. A non-partisan guest shall draw the winning ticket. Winner need not be present to win.
2. DETAILS OF RAFFLE ENTRY & PARTICIPATION.
Raffle tickets ("Tickets") are a fifty ($50) dollar donation per ticket. Entrants are encouraged to check with their tax professional as to whether this donation qualifies as a charitable donation pursuant to the rules of the Internal Revenue Service. All entries must include payment by cash, personal check, bank check or money order. Checks for Raffle donation should be made out to "RIVER TO RIVER RAFFLE TO ROLL." No refunds will be made, except in rare circumstances as determined by RIVER TO RIVER CORP. in its sole discretion. Entrants may purchase as many tickets as they wish while subject to availability.
The original printed Raffle ticket will be retained by RIVER TO RIVER CORP., and the stub entered into the drawing along with the stubs of other tickets sold. U.S. Postal regulations prohibit the mailing of Raffle tickets.
Tickets are non-transferable and can only be in the name of one (1) individual Entrant. Entrants may not sell, donate or otherwise transfer their ticket(s) to anyone. Prizes will not be issued to anyone other than the one (1) Entrant whose name is on the Entry Form. RIVER TO RIVER CORP. and/or MARION TOYOTA, reserve the right to disqualify false entries or entries suspected of being false, and any illegible, defective, incomplete, or physically altered Entry Forms and entries that do not include valid or confirmed deposited payment. RIVER TO RIVER CORP. and/or MARION TOYOTA, are not responsible for printing errors in any Raffle-related material. All entries become the property of RIVER TO RIVER CORP. and will not be returned. RIVER TO RIVER CORP. and/or MARION TOYOTA, reserve the right to withdraw this offer at any time.
3. PRIZES.
Grand Prize: The Grand Prize selected Entrant shall choose 1 vehicle of 5 possible new vehicles selected from Marion Toyota inventory on the day of the grand prize drawing. The vehicle must be picked up from Marion Toyota no later than twenty (20) days after the Grand Prize drawing. The cost of taxes, title, license, and registration and doc fees up to the amount of $2,000.00 will be donated by Banterra Bank and included as part of the grand prize. Any fees above and beyond $2,000.00 will be the responsibility of the winning entrant and must be paid in full to Marion Toyota upon taking possession of the vehicle. Car winner is responsible for transport of the Vehicle and any costs involved in its transport and or storage, if necessary. The Grand Prize Selected Entrant assumes any additional expense(s) and assumes all liabilities once the vehicle is removed from the lot, and is responsible for ensuring required motor vehicle liability insurance has been obtained.
If the Grand Prize Selected Entrant fails to affirmatively receive the vehicle within the twenty (20) days after drawing, he or she will be deemed to have elected NOT to receive the Grand Prize.
4. NOTIFICATION.
Entrant whose Ticket is drawn at the Prize Drawing will be deemed the winner of the Grand Prize. Selected Entrants will be notified by telephone using the information provided on the Entry Form. If Selected Entrant cannot be located or fails to return attempts to contact him or her within twenty (20) days after RIVER TO RIVER CORP.'s first attempt to contact him or her, such Selected Entrant will be deemed to have forfeited his or her prize. An additional ticket will be drawn until the prize is distributed to winner(s).
Each Selected Entrant must provide all information requested to be eligible to win, including proof of age, proof of identity showing that the person claiming the prize is the same Entrant named on the winning Ticket and the winning Ticket stub.
Except where prohibited by law, the Selected Entrant's purchase of a Raffle Ticket and acceptance of a prize constitutes permission for RIVER TO RIVER CORP. and/or Marion Toyota to use said selected Entrant's name, photograph, likeness, statements, biographical information, voice, and city and state address for promotional or advertising purposes in connection with this Raffle on a worldwide basis, and in all forms of media, now or hereafter known, in perpetuity, without review, permission or further compensation.
5. RULES & LIABILITIES.
The Raffle is subject to these Official Rules. These Official Rules shall not be changed by any oral statement made by any person acting on behalf of RIVER TO RIVER CORP. and/or MARION TOYOTA. By participating, Entrants agree to all of the following: (a) To be bound by these complete Official Rules and the decisions of RIVER TO RIVER CORP. and/or MARION TOYOTA. which shall be final and binding. (b) To waive any right to claim ambiguity in the Raffle or these Official Rules, except where prohibited by law. (c). By accepting a prize, Selected Entrant agrees to release RIVER TO RIVER CORP. and/or MARION TOYOTA, its officers, directors, employees, volunteers, representatives and agents, and any person or entity associated with the production, judging, or administration of the Raffle collectively, the "Releases", from and against any claims, damages, disability, attorneys' fees, and costs of litigation and settlement, as well as any liability due to any injuries, damages or losses to any person (including death) or property of any kind resulting in whole or in part, directly or indirectly, from redemption, acceptance, possession, ownership, misuse or use of any prize or participation in any Raffle-related activity or participation in this Raffle.
6. TAXES AND FEES
Actual taxes, title, license, registration and dealer doc fee up to $2,000.00 will be donated and made possible through Banterra Bank for this purpose. Each ticket purchaser is advised to consult his or her own tax advisor(s) with respect to the tax liabilities that may arise from winning a prize in this Raffle.
7. GENERAL RAFFLE CONDITIONS.
RIVER TO RIVER CORP. and/or MARION TOYOTA reserve the right to disqualify any Entrant it finds to be tampering with the entry process or the operation of the Raffle or violating these Official Rules, and reserves the right to cancel the Raffle should it suspect fraud or for reasons out of the control of RIVER TO RIVER CORP. and/or MARION TOYOTA. Disputes regarding these Official Rules and/or this Raffle will be governed by the internal laws of the City of Marion and State of Illinois. Any Claim(s) or Controversy between any of the Raffle participants and RIVER TO RIVER CORP, MARION TOYOTA and/or Banterra Bank arising out of or relating to the Raffle and or the Raffle Rules and Regulations shall be settled by binding arbitration administered in Marion, IL by the American Arbitration Association under its Commercial Arbitration Rules. Any Judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof. Caution should be taken for any attempt to deliberately damage or to undermine the legitimate operation of the Raffle. Any such attempts may be in violation of criminal and civil laws and will result in disqualification from participation in the Raffle. Should any attempt be made, RIVER TO RIVER CORP. and/or MARION TOYOTA. reserve the right to seek remedies and damages, including all fees, such as attorney fees and court costs, to the fullest extent of the law, including criminal prosecution. A Raffle Entrant's sole and exclusive remedy for any claim against RIVER TO RIVER CORP. and/or MARION TOYOTA arising out of the sale of raffle tickets or the conduction of the Raffle shall be limited to the return of the purchase price paid for his or her raffle ticket(s). In no event shall RIVER TO RIVER CORP. and/or MARION TOYOTA, its officers, directors, employees, volunteers, agents or representatives be liable to any party for any loss or injury to earnings, profits or goodwill, or for any incidental, special, punitive or consequential damages of any person or entity whether arising in contract, tort or otherwise, even if advised of the possibility of such damages.
